Oklahoma Employment Law for Martial Arts Schools: Non-Competes, Pay and Hiring Rules
Researched October 21, 2026. General information, not legal advice. Part of the Martial Arts Employment Law Center. Points we could not confirm from a primary source are marked. Confirm with an employment lawyer admitted in Oklahoma before you sign, change or enforce a staff agreement.
In Oklahoma, employee non-competes are void by statute, with narrow exceptions such as the sale of a business.
Research confidence: medium.
Can a martial arts school in Oklahoma make instructors sign a non-compete?
Oklahoma voids contracts restraining anyone from a lawful profession, trade or business (15 O.S. 217-219), except for the sale of a business’s goodwill and the dissolution of a partnership. No income threshold applies, so a noncompete with an instructor is unenforceable.
Can you stop a departing instructor from soliciting your students?
Under 15 O.S. 219A, an employee may agree not to directly solicit the sale of goods, services or both from the employer’s established customers. Clauses limited to directly soliciting your existing students are likely enforceable. Courts have refused to enforce clauses that bar former employees from accepting customers who come to them unsolicited, or from serving the public generally.
Can you stop a departing instructor from recruiting your staff?
Under 15 O.S. 219B, a clause barring an employee or contractor from soliciting your employees or contractors to leave is not treated as an illegal restraint of trade. Reasonable employee non-solicits are allowed.
What is the minimum wage for instructors in Oklahoma?
$7.25 per hour (federal rate). State Question 832, which would have raised the minimum to $12 in 2027 and $15 by 2029, was rejected by voters on June 16, 2026 (about 55% no). No 2027 increase is scheduled, and cities are preempted.
When do instructors earn overtime?
Oklahoma has no state overtime law, so the federal FLSA rule applies: time-and-a-half after 40 hours a week. The federal exempt-salary threshold ($684/week) applies.
When is the final paycheck due?
Under 40 O.S. 165.3, final wages are due by the next regular payday whether the employee is fired or quits. Earned commissions are wages and must be paid under the agreement.
What background checks can you run on instructors who teach children?
Oklahoma’s ban-the-box policy covers state/public employment, not private employers. Federal FCRA rules apply. No state law requires fingerprint checks for private martial arts schools, but the OSBI offers name-based criminal history searches and there is a public sex-offender registry. There is no salary-history ban.
Are martial arts instructors mandated reporters of child abuse?
Universal reporting: every person who has reason to believe a child is being abused or neglected must report promptly (10A O.S. 1-2-101). That includes every instructor and staff member. Report to the Oklahoma Department of Human Services statewide child abuse hotline (1-800-522-3511) or, in an emergency, to law enforcement.
What can a dress code or grooming policy require?
The Oklahoma Anti-Discrimination Act covers race, religion, sex and other traits, but it does not expressly cover gender identity and there is no state CROWN Act. Federal Title VII (15+ employees) protects religious dress, sexual orientation and gender identity.
How far can a morals or conduct clause reach into off-duty life?
Oklahoma protects employees’ lawful off-duty tobacco use (40 O.S. 500). Medical marijuana licensees have anti-discrimination protection based solely on licensed status, with exceptions such as safety-sensitive jobs and impairment at work. Recreational cannabis is not legal.
Do you have to disclose pay or allow staff to discuss it?
No pay-range posting law, no salary-history ban, and no state wage-discussion law beyond the federal NLRA.
What privacy rules apply to student and parent records?
Not confirmed — check with local counsel. Oklahoma reportedly enacted a comprehensive consumer data privacy law in 2025 (SB 546) taking effect January 1, 2026. Laws like this typically apply only to businesses handling data of 100,000+ consumers, which a typical school would fall below.
Other Oklahoma rules that catch school owners
No state paid sick leave, meal/rest break or scheduling mandates, and local mandates are preempted. Federal child labor rules govern teen assistant instructors. Oklahoma’s minimum wage act exempts very small employers (fewer than 10 full-time employees or under $100,000 gross), but the federal FLSA may still apply.
What to watch in Oklahoma
After SQ 832 failed, watch for new minimum wage proposals. Confirm the effective date and thresholds of the 2025 consumer privacy law.
The bottom line for Oklahoma schools
Leave non-competes out entirely. In Oklahoma a school’s protection rests on a confidentiality agreement, real control of the student database, and a clear rule against diverting students or payments while the instructor is still employed. Oklahoma does allow a clause barring a former employee from directly soliciting the school’s established students, which is the restrictive covenant to use.

What every martial arts school staff package should contain
- Offer or employment agreement: the legal employer, the role and duties, workplace, pay, employment status and termination terms, reviewed against local rules. U.S. at-will language does not belong in a Canadian contract.
- Compensation schedule: hourly or salary terms, commissions and bonuses, and exactly when each is earned and paid. Record all working time, not only time on the mat. See instructor pay structures and overtime.
- Appearance and conduct policies: functional uniform, hygiene and safety standards with a written accommodation process. See the dress code and grooming guide.
- Child-protection policy: boundaries, private communications, transport, supervision and reporting. See the conduct clause guide and background checks for instructors.
- Confidentiality and data-security agreement: student records, CRM access, permitted use, return and deletion, and protected-disclosure exceptions (in the U.S., the federal DTSA whistleblower-immunity notice). See student data and trade secrets.
- Restrictive-covenant addendum: only what local law permits, usually a narrow student or staff non-solicitation clause; a non-compete only in exceptional cases. See non-compete laws by state and non-solicitation agreements.

Before you act on this
This article provides general information and is not legal advice. Employment, wage, human-rights, privacy and restrictive-covenant laws change, and their application depends on the exact wording of an agreement, the employee’s duties and pay, where the work is done and when the agreement was signed. Confirm the current statute, regulations and agency guidance, and take advice from a lawyer admitted in the relevant state or province, before drafting, changing or enforcing an employment agreement.
