Hawaii Employment Law for Martial Arts Schools: Non-Competes, Pay and Hiring Rules
Researched October 21, 2026. General information, not legal advice. Part of the Martial Arts Employment Law Center. Points we could not confirm from a primary source are marked. Confirm with an employment lawyer admitted in Hawaii before you sign, change or enforce a staff agreement.
Hawaii courts will enforce an employee non-compete only if it protects a legitimate business interest and is reasonable in time, territory and scope.
Research confidence: medium.
Can a martial arts school in Hawaii make instructors sign a non-compete?
Hawaii regulates non-competes through its restraint-of-trade statute, HRS 480-4. Employment non-competes are generally allowed if reasonable, except that they are banned outright, along with employee non-solicits, for employees of technology businesses since 2015. A martial arts school is not a technology business, so an instructor’s non-compete is judged for reasonableness. There is no income threshold or notice rule. A 2025 bill (SB 1161) proposed wider limits, but its enactment was not confirmed.
Can you stop a departing instructor from soliciting your students?
Reasonable student non-solicits are generally allowed for non-technology employers.
Can you stop a departing instructor from recruiting your staff?
These are banned for technology-business employees. For a martial arts school they are judged for reasonableness.
What is the minimum wage for instructors in Hawaii?
$16.00 per hour from January 1, 2026. The next scheduled step is $18.00 on January 1, 2028, with no 2027 increase scheduled.
When do instructors earn overtime?
Time and a half after 40 hours in a workweek, with no daily overtime. Hawaii’s own salary exemption is lower than the federal level, so the federal salary test controls for exempt staff.
When is the final paycheck due?
If you fire someone, pay at the time of discharge or by the next working day. If they quit, pay by the next regular payday, or at departure if they gave one pay period’s notice. Earned commissions are wages.
What background checks can you run on instructors who teach children?
Hawaii’s ban-the-box covers private employers. You may check conviction records only after a conditional offer, may consider only convictions within the last 7 years (felonies) or 5 years (misdemeanors), excluding prison time, and the conviction must be rationally related to the job (HRS 378-2.5). Arrest records generally may not be used. Salary-history questions are banned. No statutory exception for private youth sports or martial arts programs was confirmed.
Are martial arts instructors mandated reporters of child abuse?
Hawaii’s mandated reporter list includes ’employees of any public or private agency providing recreational or sports activities,’ which very likely covers martial arts instructors. Report immediately to the Department of Human Services or the police, and notify the person in charge.
What can a dress code or grooming policy require?
Hawaii’s employment discrimination law protects religion, sex, gender identity or expression, and race, among other traits. Not confirmed whether Hawaii has enacted a hair-specific CROWN Act. Accommodate religious dress and grooming.
How far can a morals or conduct clause reach into off-duty life?
Recreational cannabis is not legal in Hawaii. No general off-duty conduct or political-activity statute for private employees was confirmed.
Do you have to disclose pay or allow staff to discuss it?
Since January 1, 2024, employers with 50 or more employees must list an hourly rate or salary range that reasonably reflects expected pay in job postings (Act 203). All employers are barred from retaliating against employees who discuss wages.
What privacy rules apply to student and parent records?
No comprehensive Hawaii consumer privacy law was confirmed as enacted. Federal COPPA applies to online collection from children under 13.
Other Hawaii rules that catch school owners
Under the Prepaid Health Care Act, employers must provide health insurance to employees who work 20 or more hours a week for 4 consecutive weeks. Employers must also provide Temporary Disability Insurance. There is no statewide paid sick leave mandate. Minors under 16 need a certificate of age to work.
What to watch in Hawaii
The minimum wage rises to $18.00 on January 1, 2028. Watch for revived non-compete restriction bills such as SB 1161 (2025) and any hair-discrimination bill.
The bottom line for Hawaii schools
If you use a non-compete at all, reserve it for senior roles with a real legitimate interest, and keep time, territory and activity narrow. Where Hawaii law allows it, a narrow student non-solicitation clause limited to students the employee actually taught, a confidentiality agreement, and real control of the student database protect a school far better.

What every martial arts school staff package should contain
- Offer or employment agreement: the legal employer, the role and duties, workplace, pay, employment status and termination terms, reviewed against local rules. U.S. at-will language does not belong in a Canadian contract.
- Compensation schedule: hourly or salary terms, commissions and bonuses, and exactly when each is earned and paid. Record all working time, not only time on the mat. See instructor pay structures and overtime.
- Appearance and conduct policies: functional uniform, hygiene and safety standards with a written accommodation process. See the dress code and grooming guide.
- Child-protection policy: boundaries, private communications, transport, supervision and reporting. See the conduct clause guide and background checks for instructors.
- Confidentiality and data-security agreement: student records, CRM access, permitted use, return and deletion, and protected-disclosure exceptions (in the U.S., the federal DTSA whistleblower-immunity notice). See student data and trade secrets.
- Restrictive-covenant addendum: only what local law permits, usually a narrow student or staff non-solicitation clause; a non-compete only in exceptional cases. See non-compete laws by state and non-solicitation agreements.

This article provides general information and is not legal advice. Employment, wage, human-rights, privacy and restrictive-covenant laws change, and their application depends on the exact wording of an agreement, the employee’s duties and pay, where the work is done and when the agreement was signed.
