West Virginia Employment Law for Martial Arts Schools: Non-Competes, Pay and Hiring Rules

Researched October 21, 2026. General information, not legal advice. Part of the Martial Arts Employment Law Center. Points we could not confirm from a primary source are marked. Confirm with an employment lawyer admitted in West Virginia before you sign, change or enforce a staff agreement.

West Virginia courts will enforce an employee non-compete only if it protects a legitimate business interest and is reasonable in time, territory and scope.

Non-competes: Enforceable only if reasonable

Research confidence: medium.

Can a martial arts school in West Virginia make instructors sign a non-compete?

West Virginia has no general statute on employee non-competes. Courts enforce them only if they are reasonable in time, geography and scope and protect a real business interest, such as customer relationships or confidential information, under Reddy v. Community Health Foundation (1982). The only statutory limit is the Physicians Freedom of Practice Act (W. Va. Code 47-11E), which covers doctors only. There’s no income threshold or notice rule. A narrow, short non-compete for a senior instructor could be enforced, but a broad one on a part-time assistant is unlikely to hold up. Bills to ban non-competes outright have been introduced and have failed.

Can you stop a departing instructor from soliciting your students?

Courts review student and customer non-solicitation clauses under the same reasonableness test. They’re generally easier to enforce than full non-competes when they’re limited to students the employee actually taught or served.

Can you stop a departing instructor from recruiting your staff?

No statute addresses them. They’re reviewed for reasonableness under common law. Not confirmed that a West Virginia appellate court has ruled squarely on them, so check with local counsel.

What is the minimum wage for instructors in West Virginia?

$8.75 per hour (W. Va. Code 21-5C-2), unchanged since January 1, 2016. The state law covers employers with 6 or more employees at one location, and federal $7.25 applies otherwise. No scheduled 2027 increase was confirmed. Cities have no separate local minimums.

When do instructors earn overtime?

Time and a half after 40 hours in a workweek. There’s no daily overtime. The state overtime law reaches employers the federal FLSA doesn’t cover. Exempt-salary rules follow the federal standard, and there’s no higher state salary threshold.

When is the final paycheck due?

Whether the employee is fired or quits, final wages are due by the next regular payday (W. Va. Code 21-5-4(b)). Late payment can cost two times the unpaid amount in liquidated damages. Earned commissions count as wages and must be paid under the commission agreement’s terms.

What background checks can you run on instructors who teach children?

No ban-the-box or fair-chance law covers private employers. The federal FCRA governs third-party background reports, and the state has no separate FCRA-equivalent confirmed. No state law requires fingerprint checks for martial arts or youth-sports instructors. If you run licensed child care, such as after-school pickup, child-care licensing background checks apply. The public sex offender registry is free to search, and the state has no salary-history ban.

Are martial arts instructors mandated reporters of child abuse?

Yes. W. Va. Code 49-2-803 names coaches and volunteers of entities that provide organized activities for children as mandated reporters, alongside youth camp staff. Report suspected abuse or neglect to the DHHR/DoHS centralized intake hotline within 24 hours. Serious physical abuse or sexual abuse must also be reported immediately to the State Police or local law enforcement. Telling the school owner does not satisfy the individual’s own duty to report.

What can a dress code or grooming policy require?

There’s no statewide CROWN Act, though some West Virginia cities have adopted local hair-discrimination ordinances (Not confirmed which; check local code). The West Virginia Human Rights Act, covering employers with 12 or more employees, protects religion, so religious dress and grooming generally need accommodation. The state act doesn’t list sexual orientation or gender identity, but federal Title VII (Bostock) covers employers with 15 or more employees.

How far can a morals or conduct clause reach into off-duty life?

State law bars firing or refusing to hire someone for lawful off-duty tobacco use (W. Va. Code 21-3-19). The Medical Cannabis Act protects an employee’s status as a medical cannabis cardholder, though you can still prohibit impairment at work. Recreational cannabis is not legal.

Do you have to disclose pay or allow staff to discuss it?

No state law requires pay ranges in job postings, and no state wage-discussion protection beyond the federal NLRA was confirmed.

What privacy rules apply to student and parent records?

West Virginia has no comprehensive consumer privacy law. Student and parent data is governed mainly by federal COPPA (for online collection from children under 13) and the general data-breach notification statute.

Other West Virginia rules that catch school owners

No paid sick leave mandate and no predictive scheduling. Teen assistant instructors are subject to federal and state child labor hour limits for 14- and 15-year-olds. Not confirmed whether West Virginia still requires work permits for minors, so check with WV Division of Labor.

What to watch in West Virginia

Minimum wage increase bills (for example HB 5485 in 2026) and non-compete ban bills are introduced regularly but had not passed as of this research.

The bottom line for West Virginia schools

If you use a non-compete at all, reserve it for senior roles with a real legitimate interest, and keep time, territory and activity narrow. Where West Virginia law allows it, a narrow student non-solicitation clause limited to students the employee actually taught, a confidentiality agreement, and real control of the student database protect a school far better.

What every martial arts school staff package should contain

  • Offer or employment agreement: the legal employer, the role and duties, workplace, pay, employment status and termination terms, reviewed against local rules. U.S. at-will language does not belong in a Canadian contract.
  • Compensation schedule: hourly or salary terms, commissions and bonuses, and exactly when each is earned and paid. Record all working time, not only time on the mat. See instructor pay structures and overtime.
  • Appearance and conduct policies: functional uniform, hygiene and safety standards with a written accommodation process. See the dress code and grooming guide.
  • Child-protection policy: boundaries, private communications, transport, supervision and reporting. See the conduct clause guide and background checks for instructors.
  • Confidentiality and data-security agreement: student records, CRM access, permitted use, return and deletion, and protected-disclosure exceptions (in the U.S., the federal DTSA whistleblower-immunity notice). See student data and trade secrets.
  • Restrictive-covenant addendum: only what local law permits, usually a narrow student or staff non-solicitation clause; a non-compete only in exceptional cases. See non-compete laws by state and non-solicitation agreements.

Before you act on this

This article provides general information and is not legal advice. Employment, wage, human-rights, privacy and restrictive-covenant laws change, and their application depends on the exact wording of an agreement, the employee’s duties and pay, where the work is done and when the agreement was signed. Confirm the current statute, regulations and agency guidance, and take advice from a lawyer admitted in the relevant state or province, before drafting, changing or enforcing an employment agreement.
