Nebraska Employment Law for Martial Arts Schools: Non-Competes, Pay and Hiring Rules
Researched October 21, 2026. General information, not legal advice. Part of the Martial Arts Employment Law Center. Points we could not confirm from a primary source are marked. Confirm with an employment lawyer admitted in Nebraska before you sign, change or enforce a staff agreement.
Nebraska courts will enforce an employee non-compete only if it protects a legitimate business interest and is reasonable in time, territory and scope.
Research confidence: medium.
Can a martial arts school in Nebraska make instructors sign a non-compete?
Nebraska has no non-compete statute; courts decide case by case and enforce a restriction only if it is reasonable, no broader than needed to protect a legitimate business interest, and not unduly harsh on the employee. Nebraska courts generally refuse to enforce a general ban on working for a competitor and will only protect against an ex-employee taking customers he or she actually dealt with. Courts will not ‘blue pencil’ (trim) an overbroad clause; they throw the whole clause out. A clause stopping an ordinary instructor from teaching martial arts anywhere within X miles is very likely unenforceable; continued employment counts as consideration.
Can you stop a departing instructor from soliciting your students?
This is the type of clause Nebraska courts actually enforce, but only for students/customers the instructor personally dealt with and had real contact with; a two-year limit on those customers has been upheld, while a ban on soliciting all of a business’s customers has been struck down. Keep the list narrow and the time reasonable, because an overbroad clause is voided entirely rather than trimmed.
Can you stop a departing instructor from recruiting your staff?
No statute addresses employee non-solicitation or no-poach clauses. Not confirmed — check with local counsel; expect courts to apply the same reasonableness test and no-blue-pencil rule.
What is the minimum wage for instructors in Nebraska?
$15.00 per hour effective January 1, 2026 (final step of the 2022 voter initiative); tipped cash wage $2.13. Starting in 2027 the rate adjusts annually for cost of living (CPI); the 2027 figure was not confirmed as of October 2026. A 2025 bill (LB258) to slow increases and create a youth/training wage failed. No major city minimums.
When do instructors earn overtime?
Nebraska has no separate state overtime law; follow the federal FLSA (time-and-a-half over 40 hours in a workweek) and the federal exempt salary level. No daily overtime and no higher state salary threshold.
When is the final paycheck due?
Under the Nebraska Wage Payment and Collection Act (Neb. Rev. Stat. 48-1230), final wages are due by the next regular payday or within two weeks of separation, whichever is sooner, whether the employee quits or is fired. Earned commissions are due on the next regular payday after the employer receives payment for the sale. Under the 2025 sick-leave amendments, unused paid sick time does not have to be paid out.
What background checks can you run on instructors who teach children?
Nebraska’s ban-the-box law covers public employers only, so private schools may ask about criminal history on the application, subject to federal EEOC guidance and the federal FCRA when using a screening company. No state law confirmed that requires fingerprint checks for private youth sports or martial arts programs. The state sex offender registry is publicly searchable through the Nebraska State Patrol. No salary-history ban.
Are martial arts instructors mandated reporters of child abuse?
Yes. Nebraska is a universal-reporting state: any person who has reasonable cause to believe a child has been abused or neglected must report it (Neb. Rev. Stat. 28-711). Report to local law enforcement or the Nebraska DHHS Child Abuse and Neglect Hotline (1-800-652-1999).
What can a dress code or grooming policy require?
LB451 (2021) amended the Nebraska Fair Employment Practice Act to treat discrimination based on natural hair texture and protective hairstyles as race discrimination; it covers employers with 15 or more employees. Religious dress must be accommodated under state and federal law. Sexual orientation and gender identity are protected under federal law (Bostock) for employers with 15 or more employees.
How far can a morals or conduct clause reach into off-duty life?
Nebraska has no general lawful off-duty conduct or lawful-products law, so reasonable morals clauses are generally allowed. Recreational cannabis is not legal; voters approved medical cannabis in 2024, but no state employment protection for off-duty use was confirmed.
Do you have to disclose pay or allow staff to discuss it?
No pay-range posting requirement and no state salary-history ban. Wage discussion is protected by the federal NLRA.
What privacy rules apply to student and parent records?
The Nebraska Data Privacy Act took effect January 1, 2025; it exempts businesses that qualify as small businesses under federal SBA standards, except that even small businesses may not sell consumers’ sensitive data without consent. Most martial arts schools fall within the small-business exemption. The Age-Appropriate Online Design Code Act (2025) targets online services and apps, not ordinary schools — check with counsel if you run an app or online platform aimed at kids.
Other Nebraska rules that catch school owners
Paid sick leave: the voter-approved Healthy Families and Workplaces Act took effect October 1, 2025, as amended by LB415. Employers with 10 or fewer employees are exempt, employers with 11-19 employees owe up to 40 hours a year, and employers with 20 or more owe up to 56 hours, accrued at 1 hour per 30 worked; workers under 16 and those working under 80 hours a year are excluded. The state minimum wage applies to employers with 4 or more employees.
What to watch in Nebraska
The amount of the first CPI-based minimum wage adjustment for January 1, 2027. Renewed attempts to change the voter-approved minimum wage or create a youth/training wage (LB258 fell two votes short in 2025). Department of Labor rules carrying out the amended sick-leave law.
The bottom line for Nebraska schools
If you use a non-compete at all, reserve it for senior roles with a real legitimate interest, and keep time, territory and activity narrow. Where Nebraska law allows it, a narrow student non-solicitation clause limited to students the employee actually taught, a confidentiality agreement, and real control of the student database protect a school far better.

What every martial arts school staff package should contain
- Offer or employment agreement: the legal employer, the role and duties, workplace, pay, employment status and termination terms, reviewed against local rules. U.S. at-will language does not belong in a Canadian contract.
- Compensation schedule: hourly or salary terms, commissions and bonuses, and exactly when each is earned and paid. Record all working time, not only time on the mat. See instructor pay structures and overtime.
- Appearance and conduct policies: functional uniform, hygiene and safety standards with a written accommodation process. See the dress code and grooming guide.
- Child-protection policy: boundaries, private communications, transport, supervision and reporting. See the conduct clause guide and background checks for instructors.
- Confidentiality and data-security agreement: student records, CRM access, permitted use, return and deletion, and protected-disclosure exceptions (in the U.S., the federal DTSA whistleblower-immunity notice). See student data and trade secrets.
- Restrictive-covenant addendum: only what local law permits, usually a narrow student or staff non-solicitation clause; a non-compete only in exceptional cases. See non-compete laws by state and non-solicitation agreements.

This article provides general information and is not legal advice. Employment, wage, human-rights, privacy and restrictive-covenant laws change, and their application depends on the exact wording of an agreement, the employee’s duties and pay, where the work is done and when the agreement was signed. Confirm the current statute, regulations and agency guidance, and take advice from a lawyer admitted in the relevant state or province, before drafting, changing or enforcing an employment agreement.
